Terms of Use

These terms are the agreement between you and HEART BEAT PACK, K.K. (株式会社ハートビートパック), which operates Nine Town (“we”, “us”). They cover the Nine Town app and this website. By creating an account or using the app, you accept them. If you do not accept them, do not use Nine Town.

1. This agreement

These terms, together with our Privacy Policy, form the whole agreement between us about Nine Town. Where the app store you installed from imposes its own terms, those apply to your purchase as well.

2. Who may use Nine Town

You must be at least 18 years old to hold an account. The app asks for your date of birth on first launch and blocks accounts that declare a younger age. Giving a false date of birth is a breach of these terms and we will close the account if we find out.

You must also have the legal capacity to enter a contract, and you must not be barred from using the service under the laws that apply to you.

3. Your account

• Keep your login details to yourself. You are responsible for what happens on your account.
• Give us accurate information, and keep your email address current so we can reach you.
• One person per account. Do not sell, rent or share your account.
• Tell us at [email protected] if you think someone else has access to it.

4. Acceptable use

We operate a zero-tolerance policy for objectionable content and abusive behaviour. You agree not to use Nine Town to create, publish, request or distribute:

• Sexual content involving minors, or any character presented as a minor, in any form. This is an absolute prohibition and we report what the law requires us to report.
• Pornographic or sexually explicit material. Nine Town is not a platform for explicit content.
• Content that depicts, encourages or glorifies non-consensual sexual activity, sexual violence, or the sexual exploitation of anyone.
• Threats, harassment, stalking, hate speech, or content that degrades people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, age or sexual orientation.
• Content that encourages self-harm, suicide, eating disorders, or dangerous acts.
• Real people depicted without their consent, including impersonation, deepfake-style likenesses, and anything presented as a real person’s actual words or conduct.
• Content that infringes someone else’s copyright, trade mark, privacy or other rights.
• Malware, spam, scraping, automated access, or attempts to break, overload or reverse-engineer the service or to work around usage limits, the age gate or content review.
• Anything illegal where you are, or where we operate.

Reporting and blocking. Every published character can be reported from inside the app, and you can block a creator so their content stops reaching you. We review reports and remove content or accounts that breach these terms, ordinarily within 24 hours of a valid report. You can also email [email protected].

5. Characters and other content you create

You keep ownership of the characters, descriptions, artwork and messages you create. We do not claim them.

To run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and transmit your content, for as long as you keep it on Nine Town. For content you choose to publish, that licence also covers displaying it to other users and showing it in the catalog and in promotional material for Nine Town. The licence ends when you delete the content, except for copies we must keep for legal or safety reasons and for copies other users made before deletion.

Publishing is reviewed. A character you create stays private until you publish it. When you publish, we run an automated content review, and a character that does not pass stays private with the reasons shown to you. Passing review is not our endorsement, and we may remove published content at any time if it breaches these terms.

You are responsible for having the rights to whatever you upload. If you believe content on Nine Town infringes your copyright, email [email protected] with enough detail to identify the work and the content, and we will act on it.

6. What the AI is, and what it is not

• The characters are fictional. They are software generating text, not people, however convincing they are. Nothing in a conversation is a relationship with a real person.
• Output can be wrong. AI-generated text and images may be inaccurate, offensive, or nonsensical, and may not reflect our views. Do not rely on it as fact.
• It is not professional advice. Nine Town does not provide medical, mental-health, legal, financial or safety advice. If you are struggling, please contact a qualified professional or your local emergency services.
• We use automated filtering and human review, but we cannot guarantee that every output will be appropriate. Tell us when something goes wrong.

7. Credits

Conversations and generated extras are paid for with credits. New accounts receive a starting balance, and you receive more each day you open the app. You can buy credit packs.

• Credits are a limited, personal, non-transferable licence to use features of Nine Town. They are not money, not a stored-value instrument, and have no cash value.
• Credits cannot be exchanged for cash, transferred between accounts, or sold.
• Bonus and promotional credits may expire; the app shows an expiry date where one applies. Credits you purchase do not expire while your account is open.
• Unused credits are forfeited when your account is closed, except where the law says otherwise.
• We may change how many credits a feature costs. Where a change is material, we will tell you first.

8. Membership and auto-renewal

Nine Town offers an optional paid membership, which includes a credit allowance for each billing period. The exact price and period are shown in the app before you confirm, and are charged in your local currency by the app store.

• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Auto-renewal. Your membership renews automatically at the end of each period unless you cancel it at least 24 hours before that period ends.
• Renewal charge. The renewal is charged within 24 hours before the current period ends, at the price then in effect for your plan.
• Cancelling. Manage or cancel at any time in your App Store or Google Play account settings — not in Nine Town, because the store holds the subscription. Cancelling stops the next renewal; you keep your membership until the end of the period you already paid for.
• Price changes. If we change the price, the store will ask for your consent before it takes effect, and your subscription will not renew at the new price without it.

9. Refunds

Purchases are processed by Apple and Google, so refunds are handled under their policies, and we cannot issue them directly. Request a refund through the App Store or Google Play.

This does not affect statutory rights you may have as a consumer, including any right of withdrawal under EU or UK law. If you think you were charged in error, email [email protected] and we will help you sort it out with the store.

10. Our intellectual property

Nine Town — the app, this site, our name, our logo and our design — belongs to us and our licensors. These terms give you a personal, revocable, non-transferable, non-exclusive licence to use the app for your own non-commercial enjoyment. You may not copy, modify, distribute, sell, or create derivative works from the app, or remove any notice from it, except where the law says you may.

11. Suspension and termination

You can stop at any time by deleting your account in Settings, or via ninetown.ai/delete-account. What happens to your data is described in the Privacy Policy.

We may suspend or close your account if you breach these terms, if we are legally required to, or if keeping it open would put other users or the service at risk. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond. Serious breaches — anything involving minors above all — result in immediate closure without notice. If we close your account for a breach, unused credits are forfeited.

We may also discontinue Nine Town, or any feature of it. If we withdraw the service entirely, we will give reasonable notice and, where the law requires, refund the unused portion of a paid membership.

12. Disclaimers and liability

Nine Town is provided “as is”. To the fullest extent the law allows, we exclude all implied warranties, and we do not promise that the service will be uninterrupted, error-free, or that it will meet your expectations.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, for lost profits or data, or for anything an AI character generates. Our total liability to you for any claim connected with Nine Town is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.

Nothing here excludes liability that cannot legally be excluded — including for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer. Some jurisdictions do not allow some of these exclusions, in which case they do not apply to you.

13. If you installed from the App Store

The following applies to the iOS version, and Apple requires us to say it:

• This agreement is between you and us only, not with Apple. Apple is not responsible for Nine Town or its content.
• Apple has no obligation to provide any maintenance or support for Nine Town.
• If Nine Town fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim by you or a third party relating to Nine Town, including product liability, regulatory non-compliance, or consumer protection claims.
• Apple is not responsible for investigating, defending or resolving any third-party intellectual property claim relating to Nine Town.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

14. Governing law

These terms are governed by the laws of Japan, and disputes will be resolved by the Tokyo District Court (東京地方裁判所). If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in, and you may bring proceedings in your local courts where the law gives you that right.

15. Changes to these terms

We may update these terms. We will change the “Last updated” date above, and for material changes we will notify you in the app or by email before they take effect. Continuing to use Nine Town after that means you accept the new terms; if you do not, delete your account.
